Terms Of Service

This Agreement supersedes any prior written or oral agreements between Liquidation Pallet Sourcing LLC (“Seller”) and the Purchaser.  Purchaser hereby acknowledges: 

1. SOLD AS IS. All merchandise is Liquidation/Salvage/Store Returns/Used and is being sold ‘as is’ with all faults and defects, whether known or unknown, presently existing or that may hereafter arise. Merchandise may be ripped, stained and/or damaged and Seller makes no warranties or representations of any kind, expressed or implied, regarding the condition of the merchandise. Neither listed department stores nor Seller shall be held liable for any dissatisfaction regarding the sale or quality of merchandise and any shortages of merchandise.
2. LOAD VALUE DISCLOSURE. Loads may be sold as bulk loads (no wholesale value, percentage, or piece count given) and the approximate value and amount of each load is merely a number that has been provided to Seller by its providers as an estimate only of wholesale or retail value at the time of the purchase. Seller has in no way has represented or guaranteed that this is the true value of the products, or the amount of each load and that all pictures of sample loads of merchandise are not representative of the entire load shipped to the Purchaser.
3. RETURN/REFUND POLICY. All purchases are final with no refunds, returns, credits, no cancelation or exchanges offered or given. If Purchaser refuses to accept a load, or any part of a load, the Purchaser assumes responsibility for all costs associated with shipping and/or storing, and redelivery of the load. A freight carrier may confiscate the refused load to recover all expenses incurred due to refusal of load delivery. Seller shall not be liable for any charges on this load. A restocking fee of 25% will be applied to any returns from refusal of load delivery.
4. LIABILITY. Seller shall not be liable by way of indemnity or by reason of any breach of the contract or of statutory duty, or by reason of tort (including but not limited to negligence) for any loss of product, for any financial or economic loss or for any indirect or consequential damage whatsoever that may be suffered by the Purchaser arising out of or relating to the purchase of this merchandise.
5. DISPUTES. Purchaser will be fully responsible for all credit card and/or other charges incurred for the merchandise and will not dispute and/or charge back a credit card purchase for any reason whatsoever.
6. INSPECTION OF MERCHANDISE. Purchaser has inspected all merchandise and agrees that the merchandise is as represented and described, and that Seller has provided all merchandise listed in the terms and conditions of sale, invoice, and bill of landing.
7. FREIGHT RATES. Seller arranges freight as a courtesy to its customers, but these are only “estimated” rates. Pallet counts and any load weights are only estimates when provided to shipping companies and/or the Purchaser.  The Purchaser is responsible for any overages, detention or lay-over fees and will be billed accordingly.
8. GOVERNING LAW. The laws of the State of Texas shall govern the validity, construction, enforcement, and interpretation of this Agreement.
9. ADVERSTISING. Purchaser shall not use the names of specific department stores in the advertising of any merchandise purchased under this agreement.
10. ACCEPTANCE. The conditions of sale will be considered accepted upon payment, shipment, and delivery of goods. By signing this agreement, Purchaser represents that they fully understand and agree to the Conditions of Sale.
